Privacy policy

At Alguacil Arquitectes we take the protection of your data seriously. Here we explain clearly what data we process, why, for how long and what rights you have, in accordance with Regulation (EU) 2016/679 (GDPR) and Spanish Organic Law 3/2018 on the Protection of Personal Data and Guarantee of Digital Rights (LOPDGDD).

This website does not collect data

• This website has no forms or sign-ups, uses no cookies and stores no personal data. The WhatsApp, phone and email buttons only open the corresponding app on your device when you tap them.
• The WhatsApp links open the chat with a pre-written greeting, such as the name of the service you are interested in, which contains no personal data. You decide whether to send it, change it or delete it.

What data we process

• We only process the data you give us when you write to us or call us: name, phone number or email address, property location, the service you are interested in and the content of your message.
• If you commission work from us, we will also process the data needed to provide and invoice it, such as your ID or tax number, address and property details.
• We do not process special categories of data or carry out profiling. Please do not send us other people's data without their consent.

What we use your data for and on what legal basis

• Answering the enquiries you send us. Legal basis: your consent, which you give by contacting us on your own initiative (Article 6.1.a GDPR). You can withdraw it at any time.
• Preparing the quote you request. Legal basis: taking steps at your request before entering into a contract (Article 6.1.b GDPR).
• Providing the services you commission and managing the professional relationship. Legal basis: performance of the contract (Article 6.1.b GDPR).
• Meeting our legal, tax, accounting and professional obligations. Legal basis: compliance with legal obligations (Article 6.1.c GDPR).
• We do not send advertising or marketing communications and we do not make automated decisions with your data.

How long we keep it

• Enquiries that do not lead to a commission: for as long as needed to deal with them and no more than twelve months after the last contact.
• Quotes not accepted: twelve months after they are sent, in case you want to pick them up again.
• Commissioned work: for the duration of the professional relationship and then for the periods required by law, such as tax rules and professional liability in construction.
• After those periods, we delete the data securely.

Providers and recipients

• We do not sell or share your data. We only disclose it when required by law, for example to the tax authorities or to the administration with which we file an application on your behalf.
• Web hosting: IONOS SE, with servers in the European Union. It acts as a data processor, and this website does not send it any personal contact data.
• Email: we receive your emails through Gmail, a Google service. Google LLC participates in the EU-US Data Privacy Framework, which ensures an adequate level of protection for transfers to the United States.
• WhatsApp: if you choose to contact us on WhatsApp, the service is provided by WhatsApp Ireland Limited (Meta group), which processes data under its own terms and privacy policy. Meta Platforms participates in the EU-US Data Privacy Framework.

Social media and advertising

• We may have profiles and publish ads on social networks such as Facebook and Instagram. If you interact with them, Meta processes your data under its own privacy policy, and we only see what you make public or send us directly.
• If you write to us through a social network, we will use your data only to reply to you, under the terms of this policy.
• Our ads link to this website, but this website does not set tracking pixels or cookies from Meta or any other platform.

Your rights

• You can exercise your rights of access, rectification, erasure, objection, restriction of processing and portability, and withdraw your consent, by writing to arcocanet@gmail.com or by post to the address above, stating which right you wish to exercise.
• We will reply within one month at the latest.
• If you believe we have not processed your data correctly, you can lodge a complaint with the Spanish Data Protection Agency (www.aepd.es).

Security

We apply appropriate technical and organisational measures to protect your data against loss, unauthorised access or misuse, and only the people at the practice who need it to assist you have access to it.

Minors

This website is not aimed at children under 14 and we do not knowingly process their data. If you are under 14, please do not send us personal data without the consent of your parents or guardians.

Server technical logs

Like any website, the hosting server may record technical data about visits, such as IP address, browser and date and time, solely to keep the website secure and working properly. This processing is based on legitimate interest (Article 6.1.f GDPR) and these logs are not used to identify you.

Changes to this policy

We may update this policy to reflect legal changes or changes to our services. The date of the latest update appears at the end of this page.
